The Legal Impossibility of Palestinian Statehood at the U.N.
On Thursday, the Palestinian Authority (PA) will again seek statehood at the United Nations. While this form of “statehood” will not confer U.N. member state status to the “Palestinian entity,” it could fundamentally reshape the Middle East, undermine international law, inhibit peace, and violate Israel’s right to exist. The resolution that the PA submitted to the U.N. General Assembly includes numerous demands that far exceed a simple (but equally illegal) grant o... Continue Reading

Israel’s Right of Self-Defense: The Legal Brief
This week, my colleagues at the American Center for Law and Justice and the European Centre for Law and Justice sent a comprehensive legal brief to all 15 members of U.N. Security Council, the U.S. secretary of state, the speaker of the House, the president pro tem of Senate, the top two party leaders in both houses of Congress, all the members of House and Senate committees on foreign affairs, and to key EU leaders and parliamentarians. The memo outlines the events that led to Israel’s cu... Continue Reading

Terrorists Use Children’s Playground as Cover for Rocket Attacks on Israel
Hamas terrorists are not only launching hundreds of Rockets at Israeli civilians, they are using Palestinian children as human shields. The Palestinian terrorists intentionally set up a launch site for their Fajr 5 rockets next to a children’s playground in Gaza. As you can clearly see from the picture above provided by the Israel Defense Forces (IDF), the launch site for their terrorist rockets is half a block away from a place of worship, a playground, and numerous other civilian targe... Maintaining Clarity in the Debate over Gaza Tactics
If the past is any guide, increased conflict in Gaza will be accompanied by international demands for Israeli restraint, frivolous accusations of Israeli war crimes, and perhaps even complaints to the International Criminal Court. Before the outcry even has a chance to build, it’s important to remember how the Law of Armed Conflict (LOAC) actually applies to Gaza. The fundamental aim of LOAC is to prevent unnecessary casualties and destruction within the context of military conflict. In p... Continue Reading

Israel Under Attack: At the Brink of War?
The situation in the Middle East is quickly escalating. Israel continues to be targeted by terrorists, with nearly 300 rockets fired into Israel from Gaza in the past few days. The latest casualties: 3 Israeli citizens killed when one of the rockets slammed into their apartment building. A young child was also critically wounded. Now, an even more troubling development. Late today, two rockets struck near Tel Aviv, deep inside Israel. Until now, the rocket fire had been confined to the border ... Continue Reading

The ICC Gets It Right . . . Finally
Common sense and the rule of law have finally prevailed. For the past three years, the Chief Prosecutor of the International Criminal Court (ICC) has been pondering whether the Palestinian Authority (PA) was capable of acceding to ICC jurisdiction. The process began in January 2009, immediately following the IDF operation in the Gaza Strip to halt the incessant rocket attacks on southern Israel, an operation for which Israel has been pilloried by the international community. In an attempt to ens... Continue Reading

The Gaza Flotilla and Lawfare
Yesterday, while driving near Denver, I caught a lengthy NPR report on the latest Gaza Flotilla. This year’s (potentially deadly) episode of protest theater stars not only Code Pink founder Medea Benjamin but also noted author Alice Walker. Walker is sailing because — and I am not making this up – she loves “children,” “water,” “trees,” and “parents who are happy.” I love those things as well, but for some reason I don’t fee...
