SCOTUS Supportive of AZ Immigration Law

It was a very good day for the State of Arizona at the U.S. Supreme Court. During oral arguments before eight Justices (Justice Elena Kagan recused herself from this case), it became clear that a majority of the Justices seem to believe that Arizona has a legitimate role in the enforcement of laws designed to protect its citizens and borders. In the run-up to today's arguments, there's been much written and said about how the Arizona immigration law is unconstitutional - that a provision that   Continue Reading...

Battle Over Protecting Our Borders Reaches Supreme Court

It is a critically important week at the U.S. Supreme Court. In a term that includes several blockbuster cases, the Justices will hear oral arguments on Wednesday on the constitutionality of Arizona's immigration law, S.B. 1070. S.B. 1070 made it a state crime to be in the country illegally and stated that an officer engaged in a lawful stop, detention or arrest must, when practicable, ask about a person's legal status when reasonable suspicion exists that the person is in the U.S. illegally.   Continue Reading...

In a little more than two months, the Supreme Court will hear oral arguments on Arizona law S.B. 1070 - a constitutionally-sound measure that is critical to the protection of Arizona's residents and borders. This immigration law has been declared unconstitutional by a federal appeals court and now the state of Arizona has taken this case to the high court. As you may know, we've backed this measure from the start - filing amicus briefs urging a federal appeals court to uphold the measure and th   Continue Reading...

Defending Arizona’s Right to Defend Its Borders and Its Citizens

Earlier today I appeared on Fox News to discuss Arizona’s latest filing in the Supreme Court case that epitomizes President Obama’s assault on the states. Arizona’s argument is simple: As a state, it has the right to protect its citizens and implement reasonable illegal immigration regulations to enforce federal law. The ACLJ is representing more than 50 Members of Congress, filing an amicus brief with the Supreme Court supporting Arizona’s right to defend itself. Repres   Continue Reading...

More DOJ Dodging over "Fast & Furious"

U.S. Attorney General Eric Holder pauses at a news conference at the Justice Department in Washington

We've told you about the decision by Patrick Cunningham, a top Justice Department official in Arizona, to plead the 5th Amendment and refuse to testify in an upcoming Congressional hearing about Operation Fast & Furious - a botched Justice Department gunrunning program that claimed the life of a U.S. Border Patrol agent after weapons ended up in the hands of Mexican drug cartels. Now, Rep. Darrell Issa, California Republican and chairman of the House Oversight and Government Reform Committee   Continue Reading...
