White House Claims False: IRS Targeting Ongoing
The White House assertion that the IRS misconduct of targeting conservative groups ended in May 2012 does not match the facts. The ACLJ has received 26 IRS questionnaires sent to 18 clients during the past year – letters demanding further intrusive and intimidating questions, with the latest inquiry coming just days before the IRS revealed its targeting scheme. During the daily news briefing on Monday, White House press secretary Jay Carney told reporters: “The misconduct had stoppe... Continue Reading

We received wonderful news late this afternoon that the United States Court of Appeals for the District of Columbia Circuit had granted an injunction in favor of our clients, Frank and Phil Gilardi and their two companies, preventing application of the HHS Mandate against them until their appeal is fully resolved. The Mandate was set to apply on April 1st, when the companies’ health plans were to be renewed. The Gilardis, who are brothers, own Freshway Foods and Freshway Logistics. These ... Continue Reading

ACLJ Presents Testimony on Pro-Life Heartbeat Bill
I testified on Mar. 26, 2013 in Topeka, Kansas at a state legislative hearing on a new pro-life bill, the Kansas Heartbeat Bill. The bill is modeled on the Ohio Heartbeat Bill, which law professor David Forte and I helped draft. The Ohio Heartbeat Bill is the brainchild of Janet Folger Porter of Faith2Action. Porter and Prof. Forte also testified at the Kansas hearing. Others testifying in support of the bill included state Rep. Pete DeGraaf, lead sponsor of the bill, and Troy Newman of Operatio... The ACLJ Protects the Distribution of Easter Event Flyers at Elementary School
An elementary school in Seekonk, Massachusetts refused a Christian student’s request to allow distribution of Easter event flyers, while allowing other students to distribute non-religious flyers. The student’s mother contacted the ACLJ informing us that the school’s Principal confiscated the flyers. When the mother contacted the Principal, she was told that “these kinds” of materials are not allowed to be distributed on campus. However, the Principal said that the ... Continue Reading

Victory After Victory…and More Coming: Latest Update on the Tea Party Cases
Last December, we updated you on our work in representing many Tea Party and other conservative groups from across the country in response to IRS refusal to grant tax-exempt status to these organizations. Many Tea Party and conservatives groups were originally targeted by the Internal Revenue Service (IRS) earlier last year, but later won tax-exempt status after more than a year-long fight by the ACLJ. In March of last year, ACLJ Senior Counsel David French told you that the ACLJ had been cont... Continue Reading

Another ACLJ Victory for Equal Access
Recently, the ACLJ received a request for legal help regarding a high school’s refusal to recognize a Christian club as an official student organization. Our client, a student in the 11th grade at Monticello High School in Monticello, New York, was interested in starting a Christian club for students who would like to meet on campus during non-instructional time to pray and discuss Christian teachings. To date, the school had recognized a variety of student clubs that were permitted to m... Continue Reading
