In this case, the Supreme Court of the United States is being asked to review the ruling of the Ninth Circuit Court of Appeals that declared the Pledge of Allegiance unconstitutional because of the phrase, "one Nation under God." The ACLJ filed an amicus brief with the Supreme Court representing members of Congress and over 150,000 citizens from all fifty states, asking the high court to take the case and ultimately to overturn the decision. On October 14, 2003, the Supreme Court announced it would hear the case. On December 19, 2003, the ACLJ filed its amicus brief on the merits supporting the current phrasing of the Pledge of Allegiance, with 68 members of Congress and 260,300 signatures of Americans representing all 50 states. The Supreme Court issued a decision June 14th rejecting the lawsuit brought by Michael Newdow in his legal challenge to the Pledge of Allegiance and the phrase "one nation under God." In its decision, the high court said Newdow did not have legal standing to bring the case and removed the federal appeals court ruling that declared the Pledge unconstitutional.
