Back in December, we had a major victory at the U.S. Court of Appeals for the Sixth Circuit involving a Ten Commandments display in Mercer County, Kentucky.  This was the first case that was decided after the Supreme Court's decisions involving the Ten Commandment cases that came out this past summer.  The Sixth Circuit ruled that the display was constitutional and that the ACLU's repeated arguments regarding church-state separation were "tiresome".  As expected, the ACLU sought review before the entire U.S. Court of Appeals for the Sixth Circuit.  This is called an en banc proceeding. 

An order came down last week from the Sixth Circuit requiring a response brief to be filed by us.  Once these briefs are submitted we will then receive word as to whether the Sixth Circuit is going to hear this case en banc.  If it is heard en banc, then all of the Sixth Circuit Court of Appeal Judges will hear the case.  This is the lead case involving the public display of Ten Commandments in the country.  Frank Manion and Geoff Surtees who have handled Ten Commandment cases all over the country are heading up the litigation on this case.  I will keep you posted as progress is made.
